Karaoke Spot Regulations and bookings at www.karaokespot.pl

§1. Definitions

  1. Organizer– The organizer and owner of Karaoke Spot is Karaoke Box Wojciech Legerski (address: ul. Westerplatte 13/7, 31-033 Kraków, NIP: 6793207057, REGON: 387341267, correspondence address: ul. Cechowa 51/2, 30-614 Kraków), email address: booking@karaokespot.pl.
  2. Regulations – These regulations define the rules for using the services provided by the Organizer.
  3. Client – A natural person, legal entity, or organizational unit that is not a legal person, who is granted legal capacity by specific regulations, who uses or has used the services provided by the organizer, including people present at the venue.
  4. Portal – The website www.karaokespot.pl which enables clients to book services.
  5. Service – All services provided by the Organizer, such as: the rental of karaoke rooms for a specified time, the sale of food and drinks, paid service in the organization of thematic events, and the service of making reservations.
  6. Venue – The place where the services are provided by the Organizer, located at ul. Westerplatte 13/7, Kraków.
  7. Price List – A document containing the current prices for the services.

§2. General Provisions

  1. All services provided by the Organizer take place in Kraków – address: ul. Westerplatte 13/7, 31-055 Kraków.
  2. The Venue has separate rooms available for rental to organize karaoke and/or themed events.
  3. Clients are obliged to read the Regulations, which is staying in the Venue and using the services provided by the Organizer means the acceptance and acknowledgment of the terms of the Regulations.
  4. All persons are required to follow the rules of the Regulations and the advice of the staff in connection with the use of services.

§3. Rules for Using the Venue

  1. During the stay at the Venue, the staff's advice must be strictly followed.
  2. The Venue staff may ask a person to leave the Venue at any time, if the person poses a threat to the safety of the staff, other people, or the Venue infrastructure, without a refund of the entry fee.
  3. The Organizer and staff may refuse to provide services to people under the influence of alcohol or other intoxicants and if the person poses a threat to the safety of the staff, other people, or the Venue infrastructure.
  4. Priority for services provided by the Organizer is given to clients with a prior reservation.
  5. The opening hours of the Venue are set by the Organizer. Opening and closing hours of the Venue may change depending on the day and the Organizer's decision.
  6. Children under the age of 13 can stay in the Venue only under the supervision of an adult.
  7. Minors under the age of 18 using the services declare that they have appropriate parental or guardian consent.
  8. The Organizer is not responsible for minors present in the Venue.
  9. Food and drinks (including alcoholic beverages) purchased only at the Venue may be consumed on the premises. It is forbidden to bring and consume food and drinks purchased outside the Venue unless previously agreed with the Organizer or Venue staff and appropriate consent is obtained (e.g., birthday cake).
  10. Alcoholic beverages are sold and served only to people who are 18 years old or older.
  11. If the staff has doubts about the age of the person ordering alcohol, they have the right to request an ID with a photo and birth date. If the person does not present such a document, the staff has the right to refuse to sell alcoholic beverages.
  12. The staff may refuse to sell and serve alcohol to intoxicated persons.
  13. It is forbidden to bring and consume illegal drugs in the Venue.
  14. Smoking tobacco products and their electronic equivalents is prohibited in the Venue.
  15. Pets are not allowed in the Venue.
  16. People using the services are aware of and agree to the possibility of their image being recorded in the form of audiovisual recordings and photographs, including as part of the overall image. 

§4. Safety Rules

  1. The Venue has monitoring to ensure the safety of people present in the Venue and the protection of property.
  2. People present in the Venue are obliged to behave in a way that does not endanger their safety and the safety of others, particularly avoiding aggressive and dangerous behavior that threatens other people present in the Venue. In such a situation, the staff may ask the person to leave the Venue without a refund of entry costs.
  3. It is forbidden to bring any illegal substances and objects into the Venue, including firearms, gas weapons, knives, sharp and dangerous objects, pyrotechnic products, and other items that may pose a threat to people and the Venue infrastructure.
  4. The staff may ask to see the contents of a backpack, handbag, shopping bag, etc., if they suspect that the person has prohibited items on the Venue premises. In case of refusal to show the contents, the staff has the right to refuse entry without a refund of entry costs.
  5. The staff, Organizer, and security may confiscate sharp and dangerous items for safety reasons.
  6. The Venue has audiovisual devices (sound system, image) that may cause vision or hearing impairment or loss. During the use of the services, loud music and flickering images may be played. People with contraindications should not use the services offered by the Organizer. By staying in the Venue, people acknowledge this information and take responsibility for any health damage caused by these devices.
  7. People present in the Venue are obliged to strictly follow the instructions of the Organizer and staff.
  8. The Venue is covered by security services provided by external companies. In case of any threat to people present in the Venue and property, the staff has the right to call security.
  9. The Organizer is not responsible for the actions and/or omissions of security companies. Any claims related to this should be directed to security companies. 
  10. People who have previously been asked to leave the Venue and still try to stay there may be asked to leave by the Venue staff or security company. 

§5. Reservations

  1. Reservations at the Venue can be made in person at the Venue or through the Portal. 
  2. The reservation is made for a specific day, time, duration of the service, and number of people.
  3. Making a reservation involves paying for the service according to the Price List.
  4. Confirmation of the reservation is proof of payment and a reservation document in case of a personal reservation at the Venue or confirmation received at the provided email address in case of a reservation through the Portal.
  5. The Organizer is not responsible for incorrectly made reservations.
  6. Changing the reservation date is possible only once, no later than 12 hours before the reservation date. Confirmation of the effective change of the reservation date is the confirmation issued at the Venue or, in case of a reservation through the Portal, receiving an email confirmation of the reservation change. 
  7. If the reservation is canceled no later than 24 hours before the reserved date, the full amount paid will be refunded.
  8. If the reservation is canceled no later than 12 hours before the reserved date, half of the amount paid will be refunded.
  9. If the reservation is canceled less than 12 hours before the reserved date, there is no possibility of a refund of any part of the amount paid.
  10. To change or cancel a reservation, you must report this fact in person at the Venue or, if the reservation was made through the Portal, by sending an email to the Organizer's email address booking@karaokespot.pl.
  11. Confirmation of the effective cancellation of the reservation is the confirmation issued at the Venue or, in case of a reservation through the Portal, receiving an email confirmation of the cancellation of the reservation. 
  12. Failure to appear by the client who made the reservation within 20 minutes after the reservation start time will result in the reservation being forfeited without a refund of the paid costs.
  13. The Organizer reserves the right to cancel the reservation without giving a reason at any time with a full refund of the paid costs.
  14. The refund of the paid amounts in cases specified in the Regulations takes place within 14 days from the date the client receives the confirmation of the reservation cancellation.
  15. If fewer people appear than specified in the reservation and this fact is not reported in advance, there is no refund of the fee paid in this regard.
  16. It is permissible for more people to arrive and be allowed to join the fun for an appropriate fee specified in the Price List, only if there is the possibility of accommodating the increased number of people in the reserved room, as decided by the Organizer.
  17. Online payments are handled by an external operator and are subject to their regulations. 
  18. The condition for making a reservation is providing true data indicated in the appropriate form, the client familiarizing themselves with the provisions of the Regulations and the Privacy Policy, and their acceptance. By making a reservation and using the services, the client confirms acceptance of the Regulations and the Privacy Policy.
  19. The client declares that the data provided in the reservation form are true and do not violate the rights of third parties.
  20. The Organizer reserves the right to carry out maintenance work on the Portal, which may cause difficulties or prevent clients from using the services (reservations). 
  21. The technical requirements for the proper functioning of the Portal are: internet connection, web browser, active email account, phone.
  22. The Price List may change, but this does not affect already made reservations. 
  23. The client who is a consumer does not have the right to withdraw from the service reservation made through the Portal in accordance with the content of Article 38 paragraph 12 of the Consumer Rights Act, i.e., in relation to service agreements related to entertainment, sports, or cultural events, if the contract specifies the date or period of the service.

§6. Liability

  1. The Organizer is not liable in particular for:
  1. Items left or lost in the Venue;
  2. Items damaged not due to the Organizer's fault;
  3. Bodily injuries and their consequences not due to the Organizer's fault;
  4. Random events that may prevent the service from being provided (e.g., power outage, force majeure, evacuations ordered by relevant authorities).
  1. Parents or legal guardians are responsible for children present in the Venue. The Organizer is not liable for children left unattended. 
  2. The Client and any person causing damage to the property in the Venue will be liable to cover the damage, particularly paying the following amounts:
  1. Vomiting, urinating, or defecating in the Venue – 500 PLN;
  2. Soiling sofas, especially due to walking on them, spilling, or staining with other substances – 400 PLN;
  3. Damaging a microphone – 400 PLN;
  4. Damaging a television or display – 1000 PLN;
  5. Damaging a control tablet – 800 PLN;
  6. Damaging the air conditioning – 800 PLN;
  7. Damaging, staining, or soiling the walls – 500 PLN;
  8. Damaging acoustic doors – 1000 PLN;
  9. Losing a locker key – 30 PLN.
  1. The above amounts may be cumulative. The Organizer reserves the right to claim compensation exceeding the specified amounts.
  2. Persons causing damage in the Venue are liable both civilly and criminally. 

§7. Complaints 

  1. All complaints regarding the services can be submitted by email to: booking@karaokespot.pl.
  2. The Organizer will consider and respond to the complaint submitted by the Client promptly, no later than within 14 days from the date of receiving the complaint.
  3. The complaint should include the name and surname of the person submitting the complaint, address details, email address for sending the response, a detailed description of the defect and the date it was found, and the preferred method of response.
  4. A consumer user has the option to use out-of-court complaint and redress methods.
  5. The possibility of using available out-of-court complaint and redress methods is possible after the complaint procedure and is voluntary, i.e., both parties must agree to the proceedings. The Organizer consents to participate in out-of-court dispute resolution proceedings with consumers.

In accordance with the Regulation of the European Parliament and of the Council (EU) No 524/2013 of May 21, 2013, on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (regulation on ODR for consumer disputes), consumers can use the online dispute resolution platform at http://ec.europa.eu/consumers/odr.

§8. Personal Data

  1. The data controller is the Organizer.
  2. Providing personal data for the use of the services provided by the Organizer is voluntary but necessary for submitting, processing, and executing the service. 
  3. Detailed information on the processing of personal data is contained in the Privacy Policy document. 

§9. Final Provisions

  1. These Regulations are available at all times on the website www.karaokespot.pl and in the Venue.
  2. In matters not covered by these Regulations, the relevant provisions of civil law, including regulations governing the rights and obligations of the consumer, apply.
  3. All rights (including proprietary copyrights) to available designs, documents (including forms), photos, and logos belong exclusively to the Organizer or entities cooperating with the Organizer.
  4. The Organizer reserves the right to change these Regulations. The Price List is an integral part of the Regulations.
  5. These regulations were published on August 18, 2023.
